>> bob: sidekick eric is not here because he is checking out his house on the shore. we hope it came out all right. we know it's important to him. >> andrea: that is it for us on "the five." thank you for watching. have a great weekend. see you next week. >> bret: a personal scandal leads to the resignation of one of the obama administration's most respected figures. this is "special report." ♪ >> bret: good evening. i'm bret baier. talk about a november surpris surprise. c.i.a. director general david petraeus is out tonight. just three days after president obama won re-election. petraeus says the reason isen extramarital affair. this is one of those stories that virtually no one saw coming. we begin with ed henry. >> reporter: officials were stunned when general petraeus

came to the president and told him that he wanted to step down. he has had a long distinguished military record of decades, architect of the surge in iraq. you will remember. in 2007 under president bush. came back and became the commander on the ground in afghanistan against president obama. the general has come under fire for the c.i.a. role in benghazi terror attack, people close to him tonight insist the resignation had nothing to do with the ips dept. this is a personal failing that he talked about today in a statement saying after being married for over 37 years i showed extremely poor judgment by engaging in an extramarital affair. such behavior is unacceptable as a husband and leader of an organization such as ours. this afternoon, the president graciously accepted my resignation. over the years president and petraeus clashed. there was especially

speculation that petraeus could be vice presidential nominee on the republican side but that never happened. they did come together after stanley mcchrystal stepped down because of the unformnate comments he made to "rolling stone" magazine and general petraeus put the differences aside and went to battlefield and served as commanderer on the ground in afghanistan. president singled him out and praised him saying he is one of the outstanding general officers of his generation. helping our military adapt to new challenges. leading the men and women in the uniform through a remarkable period of service in iraq and afghanistan. where he helpe helped the natiot war on path to responsible end. director of the central intelligence agency he served with characteristic and intellectual rigor. dedication and patriotism. that is from the president. feinsteidianne feinstein is tont saying while she does not excuse the general behavior, she regrets that the president accepted the resignation because she thinks he is critical in that job. so important in that job.

the last thing the white house wanted to do is search for new c.i.a. director. >> bret: we'll head back in a minute. thank you. of course, general petraeus was one of the first to brief lawmakers following the deadly attack on the u.s. mission in libya two months ago. chief intelligence correspondent herron has the latest to than investigation. good evening. >> reporter: thank you, bret. fox news told that the c.i.a. director will not testify next week. this is expected to be one of the most intense hearings on capitol hill on the benghazi scandal. >> at the white house briefing, spokesman jay carney pushed back on allegation the administration was not forthcoming on the benghazi attack. specifically what happened on september 11 at the white house as the president met with defense secretary and joint chiefs. >> made aware of the developments throughout the evening and days ensuing. i'm not sure what your

question is specifically. >> while they are not independent investigations, carney pointed to the state department internal review, public timeline from the defense department that lays out the military response. similar briefing last week by intelligence officials on the c.i.a. emergency response. >> next week, half dozen hearings or briefings are scheduled including the state department under-secretary patrick kennedy charged with jeff seeing the staff facilities and operation and eric boswell charged with the jeff seeing the diplomatic security for benghazi and other foreign missions. the administration emphasizes the public right to know what unfolded in benghazi, all of next week session except for one will be closed. the state department spokeswoman said it was congress' call. >> my understanding they wanted to have a conversation that incorporated classified information including intelligence reporting. >> some classified documents are available at a classified meeting room on capitol hill. senator bob corker said they were not remackable but he wants more clarity from the hearings next week.

>> we want to understand what was happening. was there a failure if intelligence information? i have had conversations with petraeus. people are still upset that the misleading comments that were made were made. >> bret: they told fox news there was genuine shock among the agency employees over sudden and abrupt departure of petraeus. on capitol hill, the lawmakers were, "flabbergasted" at the resignation and question whether they may still call or subpoena petraeus to testify now that he is a private citizen. bret? >> bret: we're justing more about this. the petraeus affair apparently was with his biographer. woman by the name of paul ab broadwell. was revealed -- there is a picture of her. in the course of an f.b.i. the f.b.i. was investigating a broader case unrelated to this. and in the course of that investigation, broadwell name came up. the f.b.i. followed that lead in doing so.

petraeus's name came up. the f.b.i. for some reason was concerned that perhaps petraeus was some sort of victim and perhaps blac blackmailing scheme. then a security breach may have been involved and that led to this. it seems like it's starting to un. the fact that f.b.i. involved is significant. >> we have seen resignation of a public figure with intimate knowledge of what happened in benghazi. we are seeing that this is not putting a lid on the situation. in fact, we're seeing it intensify. even step up to another level because if he testify on the hill. he could voluntarily go to the hill. he could be subpoenas. if he goes to any circumstances, he may lawyer up under the circumstances. >> bret: we'll continue to follow every aspect of this. thank you. >> you're welcome. >> bret: now to the fiscal cliff. just 53 days away. both president obama and house speaker john boehner are

advocating compromise, yet sticking to their guns on taxes. again, chief white house correspondent ed henry. >> even as president obama suggested the campaign is over by inviting congressional leaders to white house for fiscal cliff negotiations next week -- >> it is time to get back to work. >> he left the impression the campaign continues as the white house invited 200 supporters to the east room. for what republicans dismissed as a rally. >> we can't just cut our way to prosperity. if we're serious about reducing the deficit, we have to combine spending cuts with revenue. that means asking the wealthiest americans to pay a little more in taxes. >> the president's first public comment since election night came less than two hours after house speaker john boehner said yet again today he is ready to deal. >> this is an opportunity for the president to lead. this is his moment.

the president claimed one for his plan. the spending cut mixed with tax increases. >> i want to point out this was a central question in the election. on tuesday night, we found out that the majority of americans agree with my approach. >> boehner insisted otherwise noting the message he took by the election in which the republicans campaign against the tax increases and maintain control of the house was that tax hikes will kill jobs. >> everyone wants to get the economy moving again. everyone wants to get more americans back to work depen. it will slow down our ability to create jobs that everyone says he wants. >> the stalemate leads both sides no closer to a deal to avoid the fiscal cliff. $700 billion in spending cuts and an end to the tax rates coming at the end of the year. boehner is under pressure from conservatives to not give in on the tax rate increases he

is willing to end deductions that could raise the tax revenue. the president is getting pressure from the left. "new york times" columnist paul krugman going so far today to suggest the white house should be willing to daniel the economy to make their point with republicans. writing, "what should he do?" just say no and go over the cliff if necessary. the president said today he is open to giving in to a point. >> i want to be clear. i'm not wedded to every detail of my plan. i'm open to compromise. i am open to new ideas. i'm committed to solving our fiscal channel. i refuse to accept any approach that isn't balanced. >> the president broke with tradition not holding a news conference quickly after his re-election. aides point out he will take question next wednesday at the white house. that will coo inside with congress to come back in session to shape the debate. it will be his first

major transition beyond medical use. >> we could see the federal government come down strongly on what is happening here. we could see the sort of state experimenting with the legalization that we have seen over the past three or four years. or we could see negotiated settlement. >> fox news contacted the white house and department of justice for reaction. in a statement the d.o.j. said in part that the department enforcement of the controlled substances act remains up changed. we are reviewing the ballot initiative and have no additional comment at this time. there is no residency requirement in law, which has some of the business minded thinking tourism. we heard ideas such as weed related bus tours that scares the daylights out of those worried about the state's reputation. >> bret: alicia acuna live in denver. thank you.

this an the president graciously accepted my resignation." he is out at the c.i.a. late this afternoon we learned more about this. in fact, this came as the f.b.i. was part of the investigation. the extramarital atary we're told was with a paula broadwell seen in this picture, traveling with david petraeus. she was actually a biographer. wrote a book about petraeus and revealed she was having this affair. he was having this affair with her in the course of an investigation. f.b.i. was investigating a broader case unrelated to their affair. in the course of the investigation, broadwell's name came up and the f.b.i. followed that and believed that possibly petraeus was some sort of victim of blackmail. could have been a security breach. there was no evidence of that and f.b.i. was involved from

the beginning. the president accepted david petraeus' resignation and it comes five days before petraeus was set to testify in benghazi hearings up on capitol hill. we're told he will not testify. he could be compelled to testify. let's bring in panel. steve hayes for "weekly standard." charles lane, opinion writer for ""washington post" post." syndicated columnist charles krauthammer. steve? >> well, this raises many, many questions. when did the f.b.i. first learn of the affair? when did the president and his advisors first learn of the affair? most importantly a question i'm hearing from people on capitol hill, in the intelligence community is it possible that affair had anything to do with --

>> loss of audio ] washington, this -- [ loss of audio ] three days later petraeus testified in front of the house intelligence community and said that these were the questions asked. >> bret: other people we talked to said it wasn't about benghazi. here is what bolton said about the testify. >> nobody should operate under an illusion that congress won't get the story on benghazi. maybe it won't be on thursday but he was the director of the c.i.a. when it happened.

>> i suppose john ballton knows what he is talking about. he will be called to testify. this is one of the most dro mattic developments i think i have ever soon on national security. the director of central intelligence involved in an extramarital affair holding the highest security clearances. what an end to an incredible career of david petraeus. probably the most harolded general of the generation, in both iraq wars confidants of presidents and someone who the administration, the obama team early on thought as a possible rival to the presidency in 2012. one of the things that will probably come out and people will be looking in to is the

whole relationship between the white house and david petraeu petraeus. how all of these things fit together. extraordinary story. >> i want the follow up and say we will unravel all the threads of this in time. this is the first few hours but it's worth noting what we know. this is the end of a career of a truly great american. he did something that hadn't been done by a general since the korean war. when mccarer this by a matthew saved a war -- managed to save a career. and he did that. iraq was a lost war. it was headed for chaos. unending trouble for us, and he pulled off a surge that rescued the war. what happened after in iraq and korea are other stories but that is undeniable.

greatest achievement and he pulled it off in afghanistan. whatever happens and whatever we learn, this is a real tragedy. the other thing, there is no way this will get in way of the benghazi story coming out. in an odd way and discouraging way, now that the story is attached to a scandal it will be a story that will be pursued by the media. they were holding five protect obama before and perhaps out of lack of interest but given nature of journallism it will be become the hottest story around. main stream papers did not show any interest in the paper up to re-election. it will unravel. >> bret: steve? >> petraeus friends and associates are saying that he was looking forward to testifying. the obvious question is why can't he? he was really looking to

testifying before his resignation, there is nothing to keep him from testifying now as private citizen and telling the american public what he knows about what happened. we have been talking about the benghazi story for eight weeks and it's a critical story. it was well before the petraeus scandal. it is afterwards and it could explain the gaps that we took as inexplicable, it may explain it. but we need to hear from him. if he is looking forward to testify he ought to. >> bret: president put out a statement saying today accepted the res ig neigh of director of central intelligence agency and confident the c.i.a. will thrive and carry out the essential mission. i have the ju utmost confidence of the acting director of the c.i.a. to work every day to keep the nation safe. going forward my thoughts and prayers with dave and holly petraeus who has done so much to help military families through her own work. i wish them the best in this

difficult time. holly has done a lot with military families. sad part of this story. michael morrell takes over as c.i.a. we don't know the extent of how active they are but one would think they're very active all over the world. >> the agency, yeah, of course. this has to be demoralizing to the rank and file in the agency. they have been through a lot of directors in recent years and hear your top man was involved in something like this, doing something that you, in the rank and file would have been disciplined for. >> there is the timing aroundbe the election. if the reason he resign and i believe it is, he felt he had done something he needed to as a matter of honor resign over and also the fact that keeper of secret he is had been compromised, why if this had been going on and known by the f.b.i. is there a resignation

that waits until election day. compromise the country as a result of the compromise. the resignation has to come right away. if it's held up to election day that means again the charge at the white house levied against republicans for months politicizing national security. that in and of itself is important question. >> bret: if we find out that the white house knew about the affair, that the f.b.i. had this well before election day, the implications of that? >> implications of that are extraordinary. if robert mueller knew about this going back weeks or months at some of the information coming out suggests how does he keep that? if it compromises national security today, it compromised it on the day we learned he was having an affair. he should have been confronted immediately by that. if mueller kept it from the president orpet kept it from the country -- or if the president kept it from the

but i refuse to accept any approach that isn't balanced. >> bret: president and the mouse speaker back and forth on the issue of taxes. we stare at the fiscal cliff at the end of the year. back with the panel. charles? >> i think if you listen to nuances in the language it looks as if they're dancing around the com compromise. they offered a peace pipe at the beginning. he would raise tax on wealthy. republicans agree on that as a matter of tact reform. the president incysted that the rates have to go up for top 2%. if he claims it east a wedge in the debt it's ridiculous. cbo estimates $80 billion a year. we have deficit of $1.1 trillion every year.

it would reduce the deficit by $1.1 trillion to $1 $1.02 trillion. it's 7 cents on the dollar. for obama it's symbolism, punitive to say we'll stick it to the rich. if you listen to the statement he talked about the revenue and stayed away from rates. >> bret: said the central question in the election debated over and over again and the white house says he will veto anything that extends the bush era tax cut for top 2% of wage earners. >> but he also says i'm not wedded to every detail. all i want is to raise revenu revenue. they had to cables and one was aggressive and the other was resilltory. they asked what to do and they said ignore the aggressive one. they answered conciliatory one.

so i say aggress the conciliatory suggestion revenues and try to work on deductions eliminated. >> chuck? >> charles, as usual, is talks sense. more sense than usual because he and i agree on this. yes, they are dancing around a compromise. the key to is it the word "rates." john boehner comes back with don't raise taxes. there is a study out by the tax policy center. if you hold the tax rate, cap deduction at $50,000 a year. you raise $750 billion over ten years. it's like john boehner agreed to in priest negotiations. other members saying hey, we can cut a deal. the key, the republicans move that way on taxes. what will the president deliver on entitlements? that is boehner's bottom line

[ laughter ] >> bret: okay. >> i wish i had something that funny. the polls closed late out on the west coast. i don't think quite enough results have been paid in california. the democratic party captured two thirds in both houses of the state legislature out there as well as winning a substantial increase in income taxes to pay for new education spending. governor gerri brown the democratic party have an opportunity now to governor pure blue and we will see how that works out and they will own it. >> that's going to end well. i think what's needed most about this election is perspective. after the 2008 election, many people, conventional wisdom in washington pronounced the death of conservatism. it was time for the republic party to remake itself and two years later on the backs of the tea party, conservatives
